Update: a grand jury refused to indict the worker for assault.

      http://www.cnn.com/2011/12/03/justic...html?hpt=hp_t3

The two women who started the whole mess are still facing criminal charges.

Of course, this guy is still out of a job and may face problems with his parole officer.
Good news! Your insurance company says they'll cover you. Unfortunately, they also say it will be with dirt.

a grand jury refused to indict the worker
          Wow.

Are you folks familiar with the old lawyer's joke about a grand jury indicting a ham sandwich?

In theory, a grand jury is supposed to evaluate the district attorney's case and judge whether or not they have sufficient cause to prosecute.

In practice, however, a grand jury is really nothing more than a "rubber stamp" for the prosecution.

Only the prosecuting attorney gets to present evidence to the grand jury. Because the grand jury only hears one side of the case, it is usually a foregone conclusion that they will indict.

In New York City, prosecutors have a slang term, "runaway train," referring to a grand jury that asks too many questions, demands too much detail on the law, and takes forever - that is, longer than three minutes - to indict a defendant.

The old lawyer's joke is that by the time a grand jury finishes its term of service, they would indict a ham sandwich if the prosecutor asked them to.

So it really says something that the grand jury outright refused to indict the McDonald's employee.
