Rowan Clerk refuses Same Sex Marriage License
Collapse

it should be noted that the judge gave Kim Davis another option- to allow her deputies to issue the licenses instead of her- but she again refused. At this pont, she simply does not want to perform the duties of her job- so, I hope when the legislature reconvenes next, she will be impeached.

And as expected the GOP Presidential Candidates are weighting in- most howling about "religious freedom"

Now her son Nathan Davis is joining her on Hypocrisy Hill and refusing to issue same-sex marriage licenses. Pity it doesn't look like he'll get hit with contempt charges.

I love this part:
[Nathan] said the Christian law firm Liberty Counsel had advised the office to continue denying licenses to same-sex couples.

No, you see, she REPENTED! It means that all of that means NOTHING NOW!

There are two things here that, for me, stand out
1. The general doctrine of Separation of Church and State. Yes yes I know that is a US Constitution thing but the general principle is spread out over society (yeah I also know it is ignored on a regular basis)
2. The general thinking of Freedom FROM Religion that seems to be gaining momentum lately. WHY is it that I have to have some religion shoved down my throat by some person BUT if I try to do the same (even IF it is not really a religious belief_) they claim harassment and discrimination?????? Persecution complex anyone???? Anyone???? Bueller??? Bueller???

I might actually have some respect for her if she resigned, stating that her beliefs no longer allowed her to do her job. But apparently she wants to be able to not do her job, and still collect a paycheck.

She said she is ready to "face her judgment." She wants to go to jail. She is actively, blatantly building a case for a discrimination lawsuit for having her "freedom of religion" violated. It will fail, but it won't matter because the picture of her being escorted out of her office in handcuffs will be all over Fox "news" and will spark her GoFundMe retirement account. She is grandstanding her way to false martyrdom for personal gain.

Yeah, I saw that about the faith discovery four years ago, which does sort of decimate the claims that she had four husbands against biblical teaching etc. I find it cleaner to stick to the facts - she's ignoring the law for her own ethics and shouldn't be doing that job.

She has to stand before a judge on Thursday and explain why she should not be held in contempt. Also, its come out now that she only "found" her "Christian faith" 4 years ago. >.>

problem. Contempt of Court- at least civil contempt, which is the one where a judge just slaps you with it- has to be coercive- to get you to actually comply with the court order in this case- not punitive. For it to be punitive, she would ahve to be charged with criminal contempt, and go through a full trial. ( basically, the legal theory is that since the sanction is automatically lifted upon compliance in civil contempt, it doesn't need the same due process requirements. ( so, in this case, she would be free of sanctions by just allowing one couple to marry)
